Preamble
Please read carefully these General Terms and Conditions of Sale and General Terms and Conditions of Use of the website amletomissaglia.it.

1. Identification of the seller and Scope of application and acceptance of the general conditions of sale
These General Terms and Conditions of Sale are applied by the company Amleto Missaglia 1884 S.R.L.S. (hereinafter referred to as “Amleto Missaglia”), a limited liability company with registered office in Via Giuseppe Verdi 6, 20121 Milan – Italy, with tax code and intra-community VAT number IT 10461430968.
The purchase of the products offered on the website www.amletomissaglia.it (hereinafter referred to as the “Website”) and/or by telephone is governed by these general terms and conditions of sale of the Website itself (hereinafter “General Terms and Conditions of Sale”).
Amleto Missaglia products are intended to be sold exclusively to end consumers for personal use with the exclusion of any reseller or intermediary acting on behalf of resellers. Consequently, you declare and guarantee that you act as an end consumer and that you do not have the intention of reselling, directly or indirectly, the products sold by Amleto Missaglia purchased on the Website and/or by telephone for commercial purposes.
Amleto Missaglia may update these General Terms and Conditions of Sale at any time. The sales contract between you and Amleto Missaglia will include the terms of your order and the General Terms and Conditions of Sale applicable at the time of purchase, which prevail over any other term or condition or any other implied term deriving from commercial practices, custom or negotiations.
For each purchase of products on the Website, you will be asked to confirm acceptance of these General Terms and Conditions of Sale in force at the time of sending the order. These general terms are available below and at the time you are asked to confirm their acceptance. To express your acceptance, you must tick the box “I accept the General Terms and Conditions of Sale and consent to the processing of my personal data in accordance with the Amleto Missaglia Privacy Policy”. You may consult the applicable version of the Privacy Policy at any time by clicking on the “Privacy policy” link.

2. Reservation Conditions

2.1 Acceptance of reservation conditions and availability of products
All reservations made by telephone or on the website amletomissaglia.it require prior and full acceptance of the following reservation conditions. Confirming your acceptance orally means that you are aware of these conditions and that you have accepted them. Otherwise, you will not be able to make a reservation. Amleto Missaglia reserves the right to adapt or modify these conditions at any time. The reservation conditions applicable are those in force on the day of the reservation.
The reservation service is free of charge. It will not be subject to any billing.
“The list of products offered on the website amletomissaglia.it and/or in boutique for reservation may be modified at any time to best meet your expectations and depending on the availability of our products.”
The available products will be indicated to you:

  • for reservation by telephone;
  • on the website.

“The information relating to product availability comes directly from our boutique and/or warehouses and may exceptionally not be accurate in the event of a change in our stock. All changes will be communicated to you as soon as possible.”

2.2 Validation of the reservation
“After having had the opportunity to verify the details of your reservation, the total price and having validated all the reservation conditions, you will receive from Amleto Missaglia a phone call, an email or an SMS confirming the reservation. This document must be kept as it represents proof of reservation.”
“In the event of out-of-stock, Amleto Missaglia will inform you immediately by telephone or email.”

2.3 Time limits for product availability and duration of reservation validation
Amleto Missaglia undertakes to respond regarding product availability within eight (8) hours after your reservation request, respecting boutique opening hours.
You will be notified of the availability of your reservation by phone call, email or SMS using the contact details provided during the reservation.
Exceptionally, Amleto Missaglia may need to modify the time or date initially planned for the collection of the reserved product. Amleto Missaglia will inform you of all changes concerning the availability of reserved products.
The selected products are reserved for a period of seven (7) days from receipt of the reservation confirmation email (unless a different time limit is communicated by the Amleto Missaglia boutique). If collection is not made within this period, the reservation will be cancelled and the product may no longer be collected.

2.4 Collection methods
To proceed with the collection or payment of the product, you must provide an identity document and/or your reservation number.
To allow another person to collect and pay for the product, they must provide:

  • the email or SMS informing about the availability of your reservation, previously forwarded to the person;
  • the identity card of the other person and/or
  • a copy of your identity document.

Amleto Missaglia retains full ownership of the reserved products until payment is made. Risks relating to the products will be transferred to you when the product is collected.

2.5 Absence of right of withdrawal
The sales contract between you and Amleto Missaglia is concluded in the Amleto Missaglia boutique and not online.
Therefore, you will not benefit from the right of withdrawal provided by the Consumer Code within a distance selling system.

3. Ordering methods
For any question relating to our products or your orders, please contact our Customer Service (the “Customer Service”) by clicking on the “Contacts” link, by telephone at +39 02 874489 from Tuesday to Saturday (excluding holidays) or by email at amletomissaglia@amletomissaglia.it.
The Website allows you to order from Amleto Missaglia a selection of products from Amleto Missaglia suppliers (hereinafter “Products”), online via the Internet.
It is also possible to place orders by telephone by calling Customer Service.
The Website does not allow the placement of special orders, in particular the creation of a non-existing product or involving adaptation or customization. These General Terms and Conditions of Sale therefore do not apply to special orders. For any special order, please contact our Customer Service.

4. Availability of Products
The offer of Products is valid while stocks last. At the time of order validation, there may be a difference between the stock available online and the stock physically available (for example in the case of simultaneous orders of the same product by several customers). The sale therefore depends on the availability of Products in stock.
Furthermore, Amleto Missaglia retains ownership of the Products until receipt of the Products in accordance with the provisions of Article 7 of this document.
In the event of a change in availability, you will be immediately notified by email and/or on your personal page. In the event of unavailability of the Product after the order has been placed, we will contact you as soon as possible by email or telephone, informing you and offering you to order a replacement Product presented on the Website or to cancel the order.
We assume no responsibility in the event of stock depletion or unavailability of Products.
We reserve the right to modify at any time and without notice the Products offered on the Website and/or by telephone.

5. Order procedure

5.1 Order procedure on the Website
a. Selection of Products
At any time, you can add Products to your selection by clicking on “Add to cart” and choose to finish shopping or continue browsing.
You can view your selection by clicking on “Cart” in the top right menu, where the photos of the Products with their colors and references, chosen quantities, unit prices, and the subtotal of your selection will appear.

b. Identification
After selecting the Products, you must click on “Checkout” to start the order procedure.
If you already have a customer account, at this point you must log in by entering your password. If you do not yet have a customer account, you must create one by confirming your email address and creating a password. The username and password are strictly personal, and you agree to keep them secure and never disclose them to third parties.
Amleto Missaglia cannot in any case be held responsible for any loss, theft, or any fraudulent use of the customer account. Should any of these events occur, you agree to immediately notify Amleto Missaglia.
Creating an account allows you to:

  • track deliveries and consult previous orders;
  • add or modify shipping and billing addresses for future orders;
  • manage subscription to the Amleto Missaglia newsletter.

At any time, you can request the deactivation of your account by sending an email to Customer Service (please refer to section “3. Ordering Methods”).

5.2 Order confirmation for Website orders
a. Confirmation of delivery method
The system will ask you to confirm the chosen shipping method and enter all information necessary for correct delivery of the order, including shipping country, title, last name, first name, phone number, shipping address (or if you wish to pick up the order in boutique, and any other details or information we may consider necessary).
At the end of this step, click “Continue”.

b. Confirmation of payment method
You can use the same address indicated for shipping as the billing address or specify another. Next, the system will ask you to select a payment method (please refer to Article 6 “Prices – Accepted payment methods”) and enter the relevant information.
At the end of the order procedure described and after fully accepting these General Terms and Conditions of Sale and Use and the Website Privacy Policy, click the “buy” button.
Carefully check the correctness of your selections before confirming the order. Amleto Missaglia strives to ensure that the color and pattern of the Products depicted in photographs published on the Website are as faithful as possible to the originals; however, variations may occur, especially due to the technical limitations of reproducing colors on the customer’s computer equipment. Consequently, Amleto Missaglia cannot be held responsible for minor inaccuracies or errors in the photographs or graphic representations of the Products shown on the Website.
Some products sold by Amleto Missaglia are made with artisanal processes and natural materials. By their nature, these products may show variations between items, including variations in tone, texture, finish, or other aesthetic details.
These characteristics are intrinsic elements of the artisanal nature of the product and cannot be considered defects or non-conformities. The customer also acknowledges and accepts that these variations represent an essential feature of the product.
For questions regarding the Products, you may naturally contact our Customer Service.
For further information on payment methods (currency, accepted payment methods, etc.), please refer to the subsequent article “6. Prices – Accepted Payment Methods”.
At the end, the order is transmitted to Amleto Missaglia for processing. The sales contract will be created once the order is placed. Delivery of your Product is subject to the availability of the purchased Product (as provided in Article 4) and the actual payment of the Product price.
Amleto Missaglia reserves the right not to accept an order from a customer with whom a dispute regarding a previous order is ongoing, or if Amleto Missaglia reasonably believes that the customer has violated these General Terms and Conditions of Sale, has engaged in any fraudulent activity, or for any other legitimate reason.

c. Order summary
The customer will receive an order summary by email. This order summary will include the total amount of the order and information on the cost, essential characteristics, quantity, and price of the purchased Products. We recommend keeping the order summary in paper or electronic format.
You will then receive an email confirming the shipment of your order, to which we will attach your digital invoice.
We do our best to ensure that our communications are delivered promptly. However, some emails may be delivered to the “Spam” folder. Therefore, we recommend checking your “Spam” folder if you have not received the shipment confirmation email.
According to the applicable Italian law, Amleto Missaglia will retain the text of the contract concluded electronically between Amleto Missaglia and the customer for the period between contract conclusion and delivery date, and subsequently for ten years. The customer can access this document at any time, upon request to Customer Service and providing proof of identity.

5.3 Order procedure by telephone
It is possible to order a Product by calling our Customer Service (please refer to section “3. Ordering Methods”). Toplace an order, you will need to provide the following information (“Order Details”):

  • Product details: name and/or reference number of the desired Product, desired quantity and, if applicable, color, size, material, finish, and any other information necessary to identify the Product;
  • Personal data: title, first name, last name, phone number, email address, delivery address, and, if applicable, billing address.

We will provide you with information regarding the availability of the Product you desire. If the Product is available, the sales price, estimated pickup or delivery date, and any delivery-related costs will be communicated. Please ensure that the shipping information provided is correct, as incorrect information may cause delays or loss of your order.
Amleto Missaglia will not replace or refund if the information provided is incorrect.
If you decide to proceed with the order, you will receive an email (depending on your chosen communication method) containing Amleto Missaglia’s bank details.
For accepted payment methods, please refer to Article 6 “Prices – Accepted payment methods”, noting that we do not accept telephone transactions by dictation of credit and/or debit card numbers for telephone orders.
Once payment is made, you will receive an order summary. We recommend keeping the email sent to you. Amleto Missaglia will then proceed with processing your order.
The sales contract will be created once the order is placed. Delivery of your Product is subject to the availability of the purchased Product (as provided in Article 4) and the actual payment of the Product price. You will receive a shipment confirmation email once your order has been shipped.
The order data collected by Amleto Missaglia constitutes proof of all transactions between Amleto Missaglia and its customers. In the event of a dispute between Amleto Missaglia and one of its customers regarding a transaction made on the Website, the order data collected by Amleto Missaglia will be considered conclusive evidence of the content of that transaction.

5.4 Invoices
The invoice will be sent by Amleto Missaglia, attached to the shipment confirmation email. We do our best to ensure that each of our communications reaches you promptly. However, some emails may be classified as spam. If you have not received the shipment confirmation email, please check your Spam folder.
You can also download your digital invoices in the “Your Orders” section of your personal account. For each order, a customer account is automatically created. Access your personal account to view digital invoices.

6. Prices – Accepted Payment Methods

6.1 Prices
Product prices are indicated in euros, taxes included. Except in cases of reimbursement obtained (i) when exercising the right of withdrawal, (ii) for non-conformity defects and hidden defects, or (iii) in case of failure to meet delivery deadlines, Amleto Missaglia will not refund VAT applied to purchases made on the Website.
Amleto Missaglia reserves the right to modify, at any time and without notice, the Products offered on the Website.
Products are invoiced based on the prices displayed on the Website at the time of order transmission, depending on the availability at that time.
All orders are payable in euros and must be settled immediately upon placement.

6.2 Accepted payment methods
a. Payment by credit or debit card
The following credit and debit cards are accepted: Visa®, MasterCard®, Maestro®, and American Express®. Card payments are authenticated and secured via the 3D Secure system, also known as “Verified by Visa®”, “MasterCard® SecureCode”, or “American Express SafeKey®”. During payment, the bank requires some personal information to verify the cardholder’s identity and authorize the transaction.
How to pay with 3D Secure on amletomissaglia.it
After confirming the bank details provided (card number, expiration date, and verification code), a page will appear where you must enter the personal information requested by your bank. This may include:

  • the answer to a personal question;
  • a password previously chosen by the user;
  • a code sent via SMS;
  • your date of birth.

Once the 3D Secure code is entered and bank authorization is received, the order is finalized. You will then receive a confirmation email.
Authentication may vary depending on the bank. For any questions regarding your 3D Secure code, please contact your bank directly.
The order is shipped only after verification of the payment method and receipt of bank authorization.

b. Payment with Apple Pay
Payment with Apple Pay is possible (except for orders placed by telephone or replacements). This payment method is available on Apple devices after registering your information in the Apple Pay app.
By selecting “Add to cart”, the Apple Pay option will appear on the product page. You must select the Apple Pay payment box, then accept (i) the Amleto Missaglia General Terms and Conditions of Sale, (ii) the automatic creation of a customer account if you do not already have one using the information from your Apple account, and (iii) the Amleto Missaglia Privacy Policy.
For further information, please consult our Privacy Policy.
Ensure that your Apple account information, particularly the delivery address, is correct before confirming payment.
Amleto Missaglia is not responsible for replacement or refund if the information provided on your Apple account is incorrect.
Next, confirm your order using Touch ID, Face ID, or by entering your Apple account ID and password. After order authorization, you will be redirected to the confirmation page on amletomissaglia.it.

  • If you have an Amleto Missaglia customer account, your order will be directly assigned to it.


c. Gift vouchers received in boutiques
Gift vouchers or gift cards issued by Amleto Missaglia boutiques cannot be used to purchase Products presented on the Website.

7. Retention of title
Ordered Products remain the property of Amleto Missaglia until full payment is received.
The customer, however, assumes the risks (particularly the risk of loss, theft, and deterioration) concerning the Products from the moment they are delivered to the address indicated in the order (in the case of postal delivery) or from the moment they are collected in the boutique (in the case of in-boutique pickup).

8. Delivery and in-boutique pickup

8.1. Delivery and pickup area
a. Delivery to a postal address
Products purchased on the Website and/or by phone can be delivered worldwide. Products will be shipped to the delivery address indicated during the order process.

b. Pickup at Amleto Missaglia boutique
Orders placed on the Website can be picked up in the boutique.
You may designate another person to pick up the order in the boutique (see article 8.3 “In-boutique pickup”).

8.2. Shipping costs
Shipments (conditions apply subject to shipping service availability after purchase):

Shipments within Italy:
Standard delivery is free for orders over €499.99. Below this amount, €25 will be charged to cover shipping costs in full or in part.
Shipments to the rest of the world:
Delivery outside Italy is subject to a specific quotation depending on the destination country and shipment volume.
For shipments outside the European Union, any customs duties, import taxes, or other charges are the exclusive responsibility of the customer. Amleto Missaglia is not responsible for such costs or for delays caused by customs authorities.
Amleto Missaglia ships to numerous countries worldwide. However, the Seller reserves the right to limit, suspend, or exclude shipment to certain countries, territories, or regions, if necessary, due to legal, regulatory, commercial restrictions, international sanctions, logistical conditions, force majeure events, or other circumstances beyond the Seller’s control.
In such cases, Amleto Missaglia may refuse or cancel an order destined for such countries or territories, even after order confirmation, and refund any amounts already paid.

8.3 In-boutique pickup
When your order is available in the boutique, you will receive an email.
To pick up the order, you must present:

  • the email notifying you of order availability (printed or visible on your mobile device);
  • a valid ID.

If you chose another person to pick up the order, that person must present:

  • the email notifying them of the order availability;
  • a written authorization from you allowing them to collect your order;
  • a valid ID;
  • a copy of your valid ID.

You may pick up the order from the moment you receive the email confirming its availability in the boutique.

9. Right of withdrawal

9.1 Right of withdrawal and related deadlines
As a consumer, you have the legal right of withdrawal, which can be exercised under the conditions set out in the Italian Consumer Code. If you meet these conditions, you may exercise this right without providing reasons and without paying any penalty.
Amleto Missaglia’s general refund policy allows a return within fourteen (14) days from the delivery date of the Products, without the need to justify the reasons and without any penalty. After this period, the right of withdrawal can no longer be exercised.

9.2 How to exercise the right of withdrawal
To exercise the right of withdrawal, you must send an email to amletomissaglia@amletomissaglia.it specifying the order and/or invoice number and declaring your wish to exercise the right of withdrawal within the fourteen (14) day period.

9.3 Consequences of the right of withdrawal
In case of exercising the right of withdrawal or product non-conformity, you may return the purchased Products requesting either a replacement or a refund according to the conditions described in the following article “11. Return, replacement, and refund procedures.”

10. Changes to our Privacy Policy

10.1 On the website amletomissaglia.it
a. Return procedure
Amleto Missaglia is not responsible for loss, damage, and/or delay related to returns using a courier of your choice.
Any additional costs (taxes and/or customs duties) and/or formalities for customs clearance of a return from outside the Delivery Area are your exclusive responsibility.
When exercising the right of withdrawal, Products must be returned in their original condition and packaging, accompanied by the purchase invoice or, in the case of a partial return, by a copy.
The return of a Product for replacement or refund is at your expense. To do so, you must return the Products using your chosen shipping service within a maximum period of fourteen (14) days from the date of your withdrawal notification.
We strongly recommend taking out insurance offered by your courier. You are solely responsible for the return of the Products; Amleto Missaglia will not be responsible for loss, damage, delivery to the wrong address, or delayed delivery.
Products purchased in an Amleto Missaglia boutique cannot be replaced or returned via the Website.

b. Replacement
If you wish to request a replacement, please indicate in your email which Products you would like to receive instead of your order.
If you want the products you selected to be reserved for you, please contact our Customer Service.
If the total value of the replacement Products is higher than that of the returned Products, you must pay the price difference by bank transfer. Note that credit/debit card payments or Apple Pay are not accepted for paying any price difference resulting from a replacement.
If the total value of the replacement Products is lower than that of the returned Products, Amleto Missaglia will refund the difference (for gifts, the return can only be requested by the purchaser, and the amount will be credited to their bank account).
For replacements, standard shipping costs for the first delivery will be refunded, while shipping costs for the second delivery will be charged according to the chosen delivery method.
Replacements will be made within seventy-two (72) working hours from receipt of the Products, except in cases of unavailability of the selected Products.

c. Refund
Refunds requested will be made within seventy-two (72) working hours from receipt of the Products and confirmed by email. Refunds will be made using the same payment method used for the initial order and in the same currency used by the customer at the time of payment.
If payment was made by bank transfer, you must provide your bank details, which must match the account holder who placed the order. Please note that your bank may take up to ten (10) working days to credit the refund to your card, depending on the issuer. Amleto Missaglia cannot accelerate or influence refund timing.

d. Gifts ordered on amletomissaglia.it
Third-party recipients of gifts ordered on the Website may only request replacement of Products following the Website return procedure. Only the customer who purchased the gift can request a refund by exercising the right of withdrawal, so the credit will be issued exclusively to the purchaser’s bank account.
Otherwise, a Product replacement may only occur with another item of equal or higher value (in which case, the price difference will be borne by the gift recipient). The gift recipient must contact our Customer Service to register the replacement.

e. Conditions for returns, replacements, and refunds for orders paid with Apple Pay
If you request a replacement for an order paid with Apple Pay and the new order amount exceeds the original order, only credit card payments will be accepted. The payment platform will request your credit card details.
If you request a partial or full refund of an order paid with Apple Pay, the original order amount will be credited to your Apple Pay account.

10.2 At Amleto Missaglia boutique
a. For Products delivered to a postal address
For all Products purchased or received as gifts from the Website, a replacement or gift voucher valid for one (1) year can be requested at the Amleto Missaglia boutique within fourteen (14) calendar days from the delivery date, under the following conditions:

  • Returned Products must be in their original condition and packaging;
  • Returned Products must be accompanied by the purchase invoice or a copy for partial returns;
  • Shipping costs for the first delivery of a Product purchased on the Website will not be refunded in case of return with replacement or voucher issuance at the boutique.


b. For Products picked up in boutiques
For Products picked up in boutiques, you may request:

  • a replacement or voucher valid for one (1) year in the boutique;
  • a refund (excluding gift orders). The refund will be made using the same payment method used for the order within fourteen (14) working days.


11. Legal guarantees and commercial warranty

11.1 Legal guarantees
Products sold by Amleto Missaglia are subject to the legal guarantees provided by Articles 128 to 135-septies of the Italian Consumer Code, excluding all other guarantees, with the exception that the legal guarantee does not apply to purchases made with a VAT number (professionals) but only to final consumers.

Legal guarantee of conformity
Amleto Missaglia will deliver a Product that conforms to the contract and is free from defects at the time of delivery, meaning the Product will be suitable for the usual use expected of a product of that type and will have the characteristics described at the time of sale. Amleto Missaglia is also responsible for defects resulting from packaging, assembly instructions, or installation when entrusted by contract or carried out under its responsibility.
Amleto Missaglia is responsible for any conformity defect present at delivery and manifesting within two (2) years from delivery. Unless proven otherwise, it is presumed that conformity defects appearing within twenty-four (24) months from the delivery date already existed at delivery.
You may choose whether to have the Product repaired or replaced, except when one of these options is disproportionate or impossible. If repair or replacement is impossible, cannot occur without significant inconvenience to you, or cannot occur within a reasonable time, you may obtain a refund of the price paid and return the Product, or keep the Product and receive a partial refund, except when the defect is minor.
Returns, replacements, or refunds will be made at no cost to you and do not prevent any claims for damages and interest if you are entitled to them. The legal guarantee of conformity applies independently of the commercial warranty described in Article 12.2.

Legal guarantee against hidden defects
Amleto Missaglia will deliver a Product free from hidden defects that make it unsuitable for its intended use or so unsuitable that you would not have purchased it or would have paid a significantly lower price had you known.
This guarantee is valid only if invoked within two (2) years from the discovery of the defect.
In case of hidden defects, you may choose to return the Product and receive a refund of the price and related sale costs, or keep the Product and receive a partial refund. In all cases, it is your responsibility to comply with all guarantee conditions.
To report a conformity defect or hidden defect to Amleto Missaglia, please contact our Customer Service (see section “3. Ordering procedure”).

12. After-sales service and spare parts availability
All technically repairable Products are eligible for after-sales service. For any repair, please contact our Customer Service. Amleto Missaglia will make every effort to meet customer requests for one or more spare parts.

13. Limitation of liability
Under no circumstances shall Amleto Missaglia be liable for any damage not resulting from a failure to fulfill its obligations.
Amleto Missaglia does not guarantee that the website is free from errors or interruptions and will not be liable for damages arising from the use or inability to use the Website, except as provided by law.

14. Force majeure
Amleto Missaglia shall not be liable for delays or non-performance resulting from events beyond its reasonable control, including, but not limited to, strikes, transport interruptions, customs issues, wars, natural events, pandemics, communication network outages, or other unforeseeable circumstances.

15. Applicable law – Disputes
These General Terms of Sale are governed and interpreted in accordance with Italian law. However, pursuant to EC Regulation 593/2008 of June 17, 2008, these General Terms of Sale do not prevent Amleto Missaglia from complying with a provision more favorable to the customer that cannot be waived by agreement under the law of the customer’s country of residence.
If your complaint concerns a product, our Website, or other matters, please contact our Customer Service (see section “3. Ordering procedure”).
If you wish, you may use the online dispute resolution service provided by the European Commission, accessible at www.ec.europa.eu/consumers/odr/.
These General Terms of Sale were originally written in Italian. Notwithstanding the above, in case of dispute, pursuant to Regulation No. 44/2001 of December 22, 2000, you may refer either to the court of your domicile or to the Italian courts.
Our General Terms and, consequently, the contracts concluded with you shall be governed and interpreted in accordance with Italian law.
